1. Trademark Renewal

  • The term of registration is 10 years from the Trademark Application Date.
  • The Application Date is not backdated to the Convention Priority Date.
  • A Renewal Application can be filed within 12 months before the renewal due date.
  • A Grace Period of 6 months is available after the renewal due date.

2. Trademark Restoration

  • If the trademark is not renewed within the grace period, Restoration and Renewal are still possible within 12 months from the renewal due date.

Recordal of Changes in Owner Information

1. Assignment

To record an assignment of a registered trademark, the following documents are required:

  • Deed of Assignment – Duly executed by authorized representatives of both the assignor and assignee, witnessed, and notarized at the place of execution.
  • (for registered trademarks) – Declaring that no legal proceedings are pending against the assigned right, executed by an authorized person of the assignee, with the signature notarized.
  • Power of Authority – Simply signed by the authorized person of the assignor.

2. Merger

For recording a merger, the following documents are required:

  • Certified Copy of the Court Order confirming the merger or a Certificate of Merger.
  • Affidavit (for registered trademarks) – Declaring that no legal proceedings are pending against the affected trademark(s), executed by an authorized person of the surviving entity, with the signature notarized.
  • Power of Authority – Simply signed by the authorized person of the surviving entity.

3. Change of Name

For recording a change of name, the following documents must be provided:

  • Certificate from the State or Commercial Register evidencing the name change.
  • Affidavit confirming that there is no change in ownership of the trademark.
  • Power of Authority in the new company name, simply signed by an authorized person.

4. Change of Address

For recording a change of address, the required documents are:

  • Certified Extract from an Official Record confirming the new address.
  • Power of Authority with the updated address, simply signed by an authorized person.
