Documents Required for Filing a Trademark Application in India
To file a trademark application in India, the following documents must be submitted:
Mandatory Documents
Official Form – As prescribed under the Trade Marks Rules.
Power of Authority Form – A duly executed authorization for the legal representative.
Use basis - Intention to Use or, if the mark is already in use, the date of first use in India, along with an Affidavit under Rule 25(2) of the Trade Marks Rules 2017, and supporting documents
Affidavit under Rule 25(2) of the Trade Marks Rules, 2017 – Along with supporting documents as proof of use.
Representation of Label Mark - High-quality prints of the mark (submitted in electronic form).
Additional Documents (If Paris Convention Priority is Claimed)
Certified Copy of the Home Application – Must be submitted within two months from the Indian filing date.
Certified Translation – If the priority document is not in English, a certified translation is required.
