Statement of Use/Working Reports for Granted Patents
Filing Requirement:
Patentees and their licensees (if any) must submit separate
Statements of Working for granted patents in India. Filing
Form-27 is a statutory obligation, and non-compliance may result in penalties under
Section 122 of the Patents Act, 1970. Even if the patent is not commercially exploited, a Working Report must still be filed.
Filing Frequency & Deadline:
- A consolidated Working Report must be filed once every 3 years for each granted patent.
- The first report is due for the financial year (April 1 – March 31) immediately after the year of grant.
- The report for three financial years must be filed between April 1 and September 30 of the third financial year.
Extensions:
- An extension of up to 3 months can be requested with an official fee under Rule 131(2) of the Patents Rules.
- A further extension of up to 6 months is possible under Rule 138, subject to a punitive fee.
Public Disclosure:
Working Reports are
not confidential and are made publicly available on the Indian Patent Office website.
